Sales Office Registration – Cooperating Sales Agent (with an “active” Real Estate License) must accompany Client to Developer’s sales center, model center, and/or event locations for the Community (the “Sales Office”) on Client’s first visit to the Sales Office and register Client with Developer’s Sales Broker. Client shall be deemed to be registered to Cooperating Broker for a period of one hundred eight (180) days and Cooperating Broker will be considered a Procuring Cause of the Sale for any contract entered into by Client and Developer for the purchase of a Home (“Purchase Contract”) during that registration period. “Procuring Cause,” as is generally understood, is the party who initiates an unbroken chain of events that results in a contract and sale between the Buyer and Seller.

If Client initially visits the Sales Office without being accompanied by Cooperating Sales Agent or any other real estate agent and registers with Developer’s Sales Agent, Client shall be deemed to be registered with Developer’s Sales Broker. Developer’s Sales Broker will be considered a Procuring Cause of the Sale for any Purchase Contract entered into even if Cooperating Sales Agent or another real estate agent later accompanies Client to the Sales Office, Event or the Community during that registration period or following execution of a Purchase Contract. The registration is applicable only at the community visited. If a Client purchases a home at another community, Cooperating Sales Agent will not receive a commission unless the Cooperating Broker Sales Associate of the Cooperating Broker registers the Client at the community where the Client ultimately purchases a home.

Pre-Registration by Phone and Online – No telephone or online registration of Client with Developer’s Sales Broker is permitted without prior approval of the Developer. If pre-registration is permitted in writing, pre-registration must take place prior to the Client’s first visit to the community and Cooperating Sales Agent must accompany the Client to the community within 48 hours of the Client’s first visit. If there is no pre-registration, prior to prospects initial visit, Client shall be deemed to be registered with Developer’s Sales Broker. Developer’s Sales Broker will be considered a Procuring Cause of the Sale for any Purchase Contract entered into even if Cooperating Sales Agent or another real estate agent later accompanies Client to the Sales Office.

Commission – Developer’s Sales Broker agrees to pay Cooperating Broker a commission on the “Net Purchase Price” (as defined in the “New Sales Cooperating Broker Registration Agreement”) in a Purchase Agreement pursuant to the terms of the applicable executed commission agreement between Cooperating Broker and Developer’s Sales Broker. Please confirm details of specific community “New Sales Cooperating Broker Registration Agreement” with Developer’s Sales Agent as conditions may vary per office and/or community.
